Clarence J. Shearn, counsel for John J. Hopper in the subway injunction suit, will make another attempt to-day to carry the matter to the Court of Appeals. He has prepared a brief which he will file with the Appellate Division, contending that there are many precedents for an appeal to the highest court on a temporary injunction, and that the same right should be accorded to him.
