Birkhead wins again!
Anna Nicole Smith’s boyfriend and baby-daddy, Larry Birkhead, scored another victory in a Bahamian court yesterday.
Judges cleared the way for him to leave the island nation with his and Smith’s baby daughter, rejecting an appeal by the former Playboy bunny’s mother.
The three-member panel ruled that the vicious custody battle between Birkhead and Smith’s mother, Virgie Arthur, would likely be settled in a U.S. court and saw no reason to keep the Los Angeles photographer from leaving with his daughter.
“I’m happy, because this is nonsense, really,” Birkhead said as he left the courthouse.
Arthur had challenged a judge’s ruling this week that allowed the 34-year-old Birkhead to leave the island with 7-month-old Dannielynn, who recently was confirmed as his daughter through DNA testing.
During the hearing, Arthur said she was writing prayers in a spiral notebook that the judges would rule on her side.
“I’m talking to God,” she said.
Birkhead plans to leave for the United States as soon as he can secure a passport for the girl, his lawyer said. He had already gotten his daughter a new birth certificate, changing her last name from Stern to Birkhead, according to the tabloid TV show “The Insider.” Smith’s lawyer, Howard K. Stern, had previously claimed to be the dad.
