Update

[edit]
  • SPEEDY DELETE it and its derivatives - I contacted the sign manufacturer, and they are unwilling to license the image under a free license. They believe that doing so would allow their competitors to reuse the design in other signs. I have created a new, non-derivative SVG image that can be used in most articles in place of this image and its derivatives. I have already gone through the various wikis and made the substitution (except on my own pages, and I will do that soon). We need to locate an alternate image to use for w:Electronic signage and the related articles on other wikis. Would this photo be considered "freely licensed"? It's hard to tell. Otherwise, the images are ready for speedy deletion. I am tagging them with a Speedy tag now. Sorry to have uploaded this photo. Thanks LtPowers for catching it. :-) --Willscrlt (Talk) 02:38, 11 April 2009 (UTC)[reply]

Prior discussion

Derivative of a neon-light sculpture, with no evidence the original design is not under copyright. Powers (talk) 13:49, 16 March 2009 (UTC)[reply]

  • Keep - This is not a sculpture, but a very typical "cocktails" sign, such as you might find in any bar in the United States. The reason it might appear to be a sculpture is that it was displayed on a table at an auction. According to the photographer, it is an actual sign, not a sculpture. In addition, the sign is non-distinctive, and it is very unlikely that it could even be copyrighted for that reason. Contrast that with most of the rest of the signs in Category:Neon signs that are distinctive, rather than generic. --Willscrlt (Talk) 00:28, 8 April 2009 (UTC)[reply]
    • On the contrary, I would say most of the other signs in that category are text and therefore non-copyrightable. This one, however (and regardless of whether it's a "sculpture" or a "sign"; both are eligible for copyright protection), contains non-trivial creative elements that must be presumed to be under copyright. [edit]

It appears that [T]he sign from the auction is identical to the signs made by NeonSigns.com (see here). I am sending [sent] the site an e-mail asking them to confirm that it is one of their signs, and, if so, to clarify the copyright status of the sign. If they are the copyright holder, then I will request them to make the image available under a free license permitting derivative works and to submit the information to OTRS. Could someone point me to the information I need to give them for submitting OTRS confirmation?

That was done, and as noted above, they are unwilling to freely license the sign.

While this appears to be a clear copyvio, I'd like to request that the photo and the derivative drawings not be deleted until we receive a response back from the apparent copyright holder or a reasonable period of time passes. I know that's not the normal way of dealing with copyvios, but since it seems likely that we can get a quick response, it would be nice to not break dozens of pages and templates across several wikis that all link to this photo and its derivatives. Thanks! --Willscrlt (Talk) 06:26, 10 April 2009 (UTC)[reply]

These may be deleted ASAP now. Admins, please delete the derivatives before the original, since they refer to it.

As I indicated above, this is a very common (almost utilitarian) cocktails sign. I'm posting several other similar examples below. --Willscrlt (Talk) 07:21, 10 April 2009 (UTC)[reply]

Nearly identical
Green variations
Other variations
Words in a similar style

An admin needs to delete all four photos ASAP. It was determined conclusively that the original image, and thus the derivatives, are all copyvios. There is no point in discussing this further. That is why I added the {{Copyvio}} tag to each image, too. --Willscrlt (Talk) 11:24, 12 April 2009 (UTC)[reply]
